    Question:

CAN I STILL GET MY DIVORCE EVEN THOUGH I DON'T KNOW WHERE MY HUSBAND IS? WE HAVE BEEN SEPARATED FOR 9 YEARS.

    State:
    Louisiana
    Answer:

Yes, you can still get a divorce even though you don't know where your husband is. Assuming you've lived in Louisiana for more than 6 months and are a legal resident, you can file a no-fault action based on living separate and apart for at least 6 months, or you could file a fault action based on abandonment for one year. Normally you would be required to serve notice of the intended divorce action to your spouse in person, through the mail or by a process server. If you don't know where he is - the court will allow you to publish notice of the divorce in a local paper for a specified period of time, but you may have to prove the other methods of service don't work first. Once the service of notice requirement has been met, you divorce can proceed as normal. - The Divorce.com Team
