The differences between separation and divorce are significant. The biggest difference is that when you are “separated” you are still married, and cannot remarry. Once you are divorced, you are free to remarry. However, there are often serious legal consequences to separating that many individuals fail to consider. For example, the seemingly simple act of separating can affect the status of property that is accumulated during the separation period. Because these ramifications are different from state to state, you should contact a divorce attorney to find out what the consequences of separation are in your state.
