Divorce and property

Question:

I aquired property from my mom at a $5.00 arms length transfer is my husband entiled to it in a divorce? (NJ)

State:
New Jersey
Answer:

New Jersey is an Equitable Dsitribution state where marital property is divided according to what is fair, not neccessarily equal. Just because he is your husband does not mean he automaticallly gets 50% of the assets, the court will make that decision. The specifics surrounding your property transfer will have a bearing on the decision, such as when the transfer was made and what your financial situation was at the time and after. You will get a better picture of the potential outcome of your divorce by consulting an attorney in your area before you file. - The Divorce.com Team Wendy Jaffe and Divorce.com can only provide general information about divorce.
