Divorce and Debt

Question:

My husband and I separated and he bought a new house under his name and is not paying house payments will I incur his debt?

State:
New Jersey
Answer:

First of all, you should not wait another second to file for divorce. While it is unlikely that you would be held liable for the mortgage on the house (because you were separated at the time it was purchased and since it was purchased it in his name only and you did not sign for the loan), you certainly don't want to be in a situation where other debts he might incur might affect you. (Even if the creditors don't come after you directly, you wouldn't want your overall credit negatively impacted.) Hope this helps! Wendy Jaffe
