  • Divorce - unkown whereabouts of Spouse

    Question:

I would like to find out what the process is to get a divorce if I do not know the whereabouts of my spouse. It has been several years since we last saw each other.

    State:
    Illinois
    Answer:

You can get a divorce in Illinois on the no-fault grounds of living separate and apart for a continuous period of at least two years and irreconcilable differences are deemed to have caused an irretrievable breakdown of the marriage. You'll have to go through the motions of serving the petition to your spouse, but since you don't know where he is the court will likely allow publication to suffice as service in your case. This should be a simple, uncontested affair that will not cost you a fortune. - The Divorce.com Team
