I BEEN MARRIED FOR 1 1/2 YEAR NO CHILDREN AND NO ASSETS

Question: 

Been married for 1 1/2 year. No children and no assets. Im afraid to get divorce ecause my income is not enough to survive by myself. He have a good income. Do I have any rights to get any monetary help from him even do we been married for only this time? I live n California. Thanks

California statutes dictate that in ordering spousal support the court shall consider the duration of a marriage, the need for support and the amount and duration of the support. The longer a spouse has been out of the job market, the better the case for awarding support. Even if you have only been married a short time the court will consider the circumstances and need in your specific case in order to determine the level of support and the term of duration. You do have the right to be considered for monetary support, but the court will determine how much for how long.
