Marriage in another country

Question:

I just found out that my husband of 19 years has married another woman in Mexico and goes there every three months he has a second life. Can I divorce him for bigamy? (I'm in NY)

State:
New York
Answer:

Absolutely. There is not a state in the country that allows bigamy. Bigamy is a criminal offense and carries specific penalties. You will need to prove that the bigamy exists to the court of jurisdiction in your area and it will be considered sufficient grounds for divorce. Even if a state doesn't specifically list bigamy as a ground for divorce, the fact that it is illegal is enough to show that any such affected marriage is "irreconcilable" at the very least. - The Divorce.com Team Wendy Jaffe and Divorce.com can only provide general information about divorce.
