Marriage less than a year old

if you have been in a marriage for less than a year (in Texas) is it necessary for a divorce if no kids are involved?

There are no provisions for legal separation in Texas, so your choices are down to divorce or annulment. Being married (without children) for less than a year does not qualify for an annulment unless the marriage is invalid. The requirements for an invalid marriage include: underage marriage, marriage under the influence of alcohol or narcotics, a hidden divorce within 30 days, marriage before 72 hours had passed after the license was issued, permanent impotency, fraud, duress, mental incapacity, marriage to a relative or bigamy. If your marriage does not fall into one of those categories, you’ll have to seek a “regular” Texas divorce.
